ECNBA DISENFRANCHISED 1560 Qualified Members Of Abuja, Padded Voters List With 2,317 Non-members Of The Branch

The ECNBA of the Nigerian Bar Association has disenfranchised 1,560 qualified members of the Abuja Branch of the Association. It has also padded the voters list with 2, 317 names of voters who are non-members of Abuja Branch of the NBA.

Lex Community NG received the statement signed by the Secretary of the NBA Abuja branch, Prince Adebiyi Adetosoye and it states as follows:

Good Morning Learned Senior Advocates and Colleagues.
Following the publication of the 2nd provisional voters’ list by the ECNBA, the branch discovered that more than 70% of her eligible Abuja members whose names have been forwarded to the ECNBA by the branch in compliance with our constitution was not included.

The branch on the 24th day of June, 2020 wrote to the chairman of ECNBA through the National Secretariat of NBA complaining of this infraction and its implications.

However, we have compiled the names of all eligible voters whose names are on the original list sent to the ECNBA and same has been forwarded to ECNBA for immediate inclusion in the final voters’ list.

We believe that following our protest to the ECNBA, the ECNBA will do the needful and include the names of our members.

We also feel compelled to bring to your notice the alarming padding of the voters list in total contravention of the NBA constitution.

By the provisions of paragraph 2(f) of the second schedule of the NBA Constitution only registered members of Abuja Branch who must have paid his or her branch due and practicing fee as at when due can be eligible to vote from Abuja and only the chairman of a branch is constitutionally empowered to compile the list of qualified voters.

However, in the case of Abuja list, we discovered the following disturbing revelations.

  1. Total number of names on 2nd Abuja provisional list for Abuja is 2,860.
  2. Total number of qualified members sent from the branch in compliance with the NBA constitution and directive of ECNBA is 2,133.
  3. Total number of Abuja members whose names were included in the 2nd provisional list published by the ECNBA is ONLY 543 out of the 2,133 names sent from the branch.
  4. Total number of Names smuggled into the Abuja list not sent by the branch, but unilaterally included by the ECNBA is 2,317 names. IT IS NOTEWORTHY THAT THIS IS A FUNDAMENTAL BREACH OF THE CONSTITUTION, AS MOST OF THESE NAMES ARE NEITHER MEMBERS OF ABUJA BRANCH NOR HAVE ANY EVIDENCE OF MEMBERSHIP OR PAYMENT OF BRANCH DUES
  5. Total number of disenfranchised Abuja Members is 1,590

The branch cannot comprehend why over 2,317 names were included in the Abuja list in total breach of the NBA constitution and almost 1,600 legitimate voters removed from the list.

We have brought this information to your attention to keep you updated and alert and to also assure you that we are working assiduously to ensure no qualified member of the branch is disenfranchised.
