Remote Courts: Constitutional Scrutiny Of 1st Online Conviction By Marx Ikongbeh

The Lagos State High Court took the commendable step of adopting remote hearings which it debuted on 4 May 2020. Sadly however, an analysis of the proceedings leaves the strong impression that it did not comply with the constitutional right for a public trial. Considering that a death sentence was handed down, it’s our opinion in this article that the judgment is liable to be set aside.

While I fully support the adoption of technology in the justice system including remote hearings, I fear that an uncoordinated approach will defeat the objectives of remote hearings and leave the justice sector worse off.

My opinion remains that we should look closely at the system and optimize it, otherwise throwing technology over the system as it is will lead nowhere better than we currently are. I earnestly hope we get it right in Nigeria
